Enforcement Notice - Hearing - IN THE MATTER OF Robert Adrian Crandall - Motion Decision and Disciplinary Hearing

FREDERICTON, Sept. 30, 2015 /CNW/ - Following a motion held on July 14, 2015, a Hearing Panel of the Investment Industry Regulatory Organization of Canada (IIROC) ordered the following in the matter of Robert Adrian Crandall:


Mr. Crandall's motion to disqualify one member of the Hearing Panel due to an apprehension of bias is dismissed;


Mr. Crandall's motion to require that the Hearing Panel be composed exclusively of members whose mother tongue is English is dismissed; and


Mr. Crandall is directed that he cannot use the material provided to him at the conclusion of the investigation in this matter (the "Disclosure") for any purpose other than the defence of this proceeding.  He is also directed that he cannot provide copies of the Disclosure to, or share the contents of the Disclosure with, anyone other than a lawyer or agent retained by him to defend this proceeding.

The motion relates to a disciplinary proceeding initiated against Mr. Crandall which alleges that he engaged in excessive trading, unauthorized discretionary trading and made unsuitable recommendations.  The Notice of Hearing which sets out the allegations is available at:

The matter is now scheduled to proceed to a disciplinary hearing before the Hearing Panel.

IIROC formally initiated the investigation into Mr. Crandall's conduct in July 2013. The alleged violations occurred while he was a Registered Representative with the Fredericton, New Brunswick branch of Wellington West Capital Inc. and its successor National Bank Financial Inc., both IIROC-regulated firms at the relevant times.  Mr. Crandall is no longer a registrant with an IIROC-regulated firm.
