EDMONTON, May 3 /CNW/ - The City of Edmonton is bringing the Applicants in Lucy's case - Tove Reece, Zoocheck Canada Incorporated and People for the Ethical Treatment of Animals, Inc. - into the Edmonton Court of Queen's Bench on Tuesday May 4, 2010. The City alleges that the Applicants do not have the necessary legal interest to bring the matter to Court and that the declaration that the City is in breach of the Animal Protection Act constitutes an "abuse of process." Though technical, the City is seeking to knock the entire Lucy application out of Court.
In fact, the Applicants are representing the interests of Edmontonians who don't want their tax dollars used to keep Lucy in an environment and state of health that are so poor that they violate provincial animal protection law. Also, it cannot be an abuse of process to use the Courts to hold municipal government accountable for how it uses its power and taxpayer money. We say the law is on our side and that the Courts should hear the case, since the City has long refused to treat Lucy decently.
