Ruling in Filesharing Suit Imposes new Safeguards for Canadians
Framework discourages copyright trolling
CHATHAM, ON, Feb. 21, 2014 /CNW/ - TekSavvy Solutions Inc., one of Canada's leading independent telecommunications service providers, views yesterday's federal court ruling in Voltage Pictures v. Does as providing a positive new consumer rights framework when copyright holders seek personal information about ISP customers.
"We are pleased with these new safeguards and are proud to have played a role in increasing the protection of consumers," said Marc Gaudrault, CEO of TekSavvy Solutions Inc. "Until the conditions of the order are fully met we will not release customer information. TekSavvy will maintain a role in the court process moving forward to ensure that our customers' rights continue to be at the forefront of these proceedings."
In 2012, U.S.-based Voltage Pictures filed a lawsuit demanding that TekSavvy disclose personal information including telephone numbers and email addresses of approximately 2,000 subscribers who Voltage said had infringed its copyright. The ruling introduces conditions designed to protect subscribers' privacy and discourage copyright trolling in Canada. The Federal Court ruling limits Voltage's request to name and address information only, and maintains strong court oversight on how this information is used and when it is disclosed. This creates a protective framework for this and future mass requests of consumer information.
TekSavvy will be advising customers of the order and the specific outcomes of the ruling. No customer information will be provided to Voltage unless and until all conditions of the court order are met.
