LONDON, ON, March 16, 2012 /CNW/ - The Royal Canadian Mounted Police London Detachment Commercial Crime Section has issued a warrant for the arrest of Davi JOE, age 42, for alleged offences under the Bankruptcy and Insolvency Act. It is alleged that Davi JOE, owner of MAYLAN FLIGHT ACADEMY, knowingly made a material omission in his statement of affairs and attempted to conceal or remove property during the bankruptcy process. The allegations relate to the concealment of two motor vehicles and the failure to disclose an outstanding debt in the form of promissory notes totaling more than $300,000.
In December of 2010, students of London's MAYLAN FLIGHT ACADEMY brought information to the Office of the Superintendent of Bankruptcy regarding the flight school's operations shortly after the school closed and the owner filed for bankruptcy.
In December of 2011, the Ontario Region Special Investigation Unit of the Office of the Superintendent of Bankruptcy issued an Investigation Order to the RCMP identifying concerns with regard to the MAYLAN FLIGHT ACADEMY bankruptcy. Further investigation by the RCMP led to charges. A warrant was issued when Davi JOE could not be located.
The Bankruptcy and Insolvency Act permits a debtor to obtain a discharge from his or her debts, subject to certain conditions and requirements. These requirements are imposed to preserve and protect the integrity of Canada's insolvency process for the general benefit of investors, lenders, consumers and the broader public interest.
"The combined efforts of the RCMP and the Office of the Superintendent of Bankruptcy are committed to preventing abuse of the bankruptcy process by investigating offences such as the concealment of assets," stated Inspector Dwight Blok, Officer in Charge of RCMP London Detachment.
