MONTREAL, Oct 5 /CNW Telbec/ - Exploration Orbite (TSX: ORT.A) is pleased to announce that one of its patent applications has been accepted by the United States Patent and Trademark Office (USPTO), the U.S. intellectual property protection organization affiliated with the United States Department of Commerce.
The upcoming patent will cover all alumina and related products manufactured using Orbite's process in the United States. It will protect the company's technology and give it special access to a market where a considerable proportion of the world's aluminum and aluminum-based products are consumed in various forms.
The U.S. patent will spur growth for Orbite by protecting its technological process, including all related products and other derivatives. The legal protection provided by the patent will also be easy to enforce since all alumina produced by Orbite bears a very unique signature. Aluminum made from it is therefore easy to identify using a simple portable device.
"Without a shadow of a doubt, this is a critical step for Orbite. Getting the green light for our patent in the United States shows how innovative our alumina production technology is and, by the same token, ensures that our manufacturing process and derivative products will be fully protected. In concrete terms, this means that any products from Orbite's process will require our authorization before being sold in the U.S. This clearly puts us in a very enviable position—from a commercial and technological point of view—in the world's biggest market. In many respects, this patent is one of the keystones of our future growth," said Exploration Orbite president and CEO Richard Boudreault.
Tellingly, U.S. authorities accepted all of the company's patent claims outright. Not a single part of the patent was rejected by the U.S. examiner, whose only official communication was the notice of acceptance. The exceptionally fast approval demonstrates just how innovative and unique the process is.
Orbite's Canadian patent application was also recently approved and is soon expected to be granted. The company has also filed similar patent applications in Australia, Brazil, China, Europe, India, Japan, and Russia. The fact that the U.S. and Canada have approved the company's patent application will likely have a very positive impact on the patent application process in these other countries.
