MISSISSAUGA, ON, May 11, 2015 /CNW/ - The Town of Milton, its mayor and two town officials are being sued for more than $150 million by TSI International Canada, a Mississauga-based Canadian real estate developer.
In addition to the town itself, the suit names Milton mayor Gordon Krantz and two senior Milton planners, Bill Mann and Barbara Koopmans.
The suit, filed in the Ontario Superior Court of Justice, alleges the damages suffered by TSI are in part the result of a secret council vote in January, 2013, which was not publicized in advance. It further alleges that the vote itself was held illegally at a closed council meeting, in contravention of Ontario law, namely, the Municipal Act.
The secret vote in 2013 had the effect of revoking an earlier resolution passed by Milton in June, 2010, that would have permitted TSI to build single family homes on a 41 hectare parcel of land adjacent to the hamlet of Campbellville.
TSI is also currently before the Ontario Municipal Board, taking on the Region of Halton, for the Region's refusal to approve the original 2010 Milton resolution which the Town later secretly rescinded, only informing TSI after the fact.
The TSI lands in question, a former quarry, are bracketed on one side by an existing subdivision and on the other by an industrial park.
