ASC alleges Edmonton exempt market dealing representative improperly sold investments
CALGARY, Dec. 21, 2018 /CNW/ - The Alberta Securities Commission (ASC) has issued a Notice of Hearing against Kenton Roy Rustulka (Rustulka) in connection with the sale of exempt market securities while employed with the exempt market dealer firm WealthTerra Capital Management Inc. According to the Notice of Hearing, $6.5 million was raised from investors between January 1, 2013 and June 3, 2016, earning Rustulka commissions of approximately $460,000.
ASC staff allege that Rustulka, a former Edmonton police officer and senior pastor, materially misled investors as to the high risks associated with exempt market securities. It is further alleged Rustulka failed to comply with Know Your Client and suitability obligations, and aided certain of his clients in obtaining borrowed money to make leveraged purchases, resulting in his clients purchasing unsuitably high-risk investments.
The allegations have not been proven.
