MONTRÉAL, Oct. 27, 2015 /CNW/ - Today, the Québec Court of Appeal ordered Rothmans, Benson & Hedges Inc. to make a security deposit of CAD 226 million in six quarterly installments of approximately CAD 37.6 million pending its appeal of the Québec class actions judgment. The Court's order requires RBH to furnish that security in equal quarterly installments from December 2015 through March 2017. The security deposit is payable to Plaintiffs in the Québec class actions only if the underlying judgment is affirmed.
"RBH remains focused on its appeal of the underlying judgment. RBH believes it has strong arguments for reversal of the judgment given plaintiffs' total failure of proof that any class member smoked because of any alleged wrongdoing by RBH," said Anne Edwards, RBH spokesperson.
The Court of Appeal has scheduled oral arguments on the underlying appeal for November 2016.
The cases are Imperial Tobacco Canada Ltd., et al. v. Létourneau (the addiction class), and v. JTI-Macdonald Corp., et al. v. Conseil Québécois sur le Tabac et la Santé (CQTS) et Blais (the disease class) (Court of Appeal of Québec).
