Multi-million dollar class action lawsuit launched on behalf of injured workers against the Workplace Safety and Insurance Board
Public meetings planned in Toronto area to support lawsuit
TORONTO, May 8, 2014 /CNW/ - Toronto lawyer Richard A. Fink has launched a multi-million dollar lawsuit on behalf of injured workers against the Workplace Safety and Insurance Board alleging misfeasance in public office.
The lawsuit seeks a declaration from the Superior Court of Justice that the Board acted in bad faith when it reduced Non-Economic Loss awards for thousands of injured workers in Ontario without legal authority. The lawsuit seeks damages from the Board for its behavior, including expenses incurred by workers challenging decisions on their claims.
Non-Economic Loss awards are granted by the Board to injured workers who suffer permanent physical and psychological impairments from a work related injury or illness. The lawsuit claims that the Board reduced legitimate NEL claims due to pre-existing medical conditions which had not previously caused any impairment.
Richard Fink states, "The Board moved aggressively to reduce its costs by clawing back legitimate awards to injured workers, forcing them into lengthy and costly legal battles to win back what they should never have lost! The lawsuit seeks to right this wrong and hold the Board to account for its actions."
