LAVAL, QC, Jan. 24, 2012 /CNW Telbec/ - Hart Stores Inc. (TSXV: HIS)
wishes to clarify information from its press release of January 20,
2012 regarding its proposed Plan of Arrangement under the Companies' Creditors Arrangement Act (Canada), in light of inaccurate media reports.
Hart Stores' Plan of Arrangement calls for the Company to make payments
totaling $6 million over three years to the Monitor (RSM Richter Inc.)
under the CCAA, for distribution to Hart Stores' unsecured creditors.
Under the Plan of Arrangement, unsecured creditors may elect to receive
their pro rata share of the $6 million, or a lump-sum payment equal to
the lesser of the value of their claim or $1,000.
As at August 30, 2011, the date on which Hart Stores received protection
under the CCAA, Hart Stores owed approximately $23.1 million to its
unsecured creditors. Unsecured creditors as of August 30, 2011, as well
as certain of Hart Stores' lessors and employees, have until
January 31, 2012 to file their proofs of claim with the Monitor. Hart
Stores estimates that its proposed payment of $6 million will represent
approximately $0.20 for each dollar owed to those persons.
The proposed payment of $6 million under the Plan of Arrangement does
not directly affect Hart Stores' secured creditors.
RSM Richter Inc. has been appointed Monitor pursuant to the Initial
Order of the Québec Superior Court. All inquiries regarding the CCAA
proceedings should be directed to the Monitor. Further information
