MONTREAL, Jan. 13, 2012 /CNW Telbec/ - A notice of application for
judicial review was filed in the Federal Court of Canada today to
contest the legality of Canada's withdrawal from the Kyoto Protocol.
This legal action was launched by law professor Daniel Turp of the
Université de Montréal.
The Federal Court is being asked to declare that Canada's withdrawal is
in violation of the Kyoto Implementation Act. The court is also being
asked to declare that the withdrawal contravenes the principle of
democracy, the rule of law and the separation of the executive power of
the state from its legistative power.
