Jets to Diamonds... Will there be Justice for Jurgen Prince von Anhalt?
TORONTO and BEVERLY HILLS, Calif., Oct. 10 /CNW/ -- The following was
released today by Jurgen Prince von Anhalt:
Jurgen Prince von Anhalt world renowned contemporary artist, who paints
using the turbines of jet aircraft as his brush, is presently before the
courts in Ontario, Canada, fighting to retain his majority shareholdings in
Lydia Diamond Exploration of Canada Ltd. ("Lydia"). In civil proceedings
before the Superior Court of Justice, Jurgen stands accused of violating
Ontario securities law by trading in securities while unregistered and without
a prospectus or without an exemption from the prospectus requirements under
Ontario securities legislation. As a result, the regulatory authorities have
applied for an order from the Court to seize or cancel Jurgen's shareholdings
"Prince von Anhalt has consistently maintained that he is innocent of
these regulatory violations. He has long suspected and alleges that insiders
at Lydia were involved in a conspiracy to force him out of the company to gain
control of Lydia. These individuals have apparently used the securities
regulatory process in Ontario to further their illicit purpose", said David
Milosevic, Barrister for Jurgen Von Anhalt.
CTV television in a letter from their associate producer Patti-Ann
Finlay's office asks, "To date, media reports have focused on the involvement
of Prince Jurgen von Anhalt and [former] Princess Emilia von Anhalt in the
Lydia Diamond shareholders matter according to the OSC and its enforcement
proceeding. An important, but absent, element of the story is how the OSC
handled the process. We would also be very interested in learning about the
involvement of others -- especially if the OSC is aware -- but has chosen to
ignore -- their involvement. I have already begun, through our search house,
to gather information related to particular board members and their
activities. Certainly, if you have information (i.e. evidence) that reveals
the involvement of other individuals, we would be interested in receiving it.
As you suggested, transcripts of the OSC interviews with board members, are
expected to reveal their participation".
"Evidence recently obtained pursuant to a court order has disclosed the
leading role of various Lydia insiders in the violations that Prince von
Anhalt stands accused of. These insiders conceived of a plan to sell Lydia
securities in violation of Ontario securities laws. They then apparently
orchestrated a plan that would see Jurgen prosecuted for the illegal trades
they conceived of and themselves carried into effect," says David Milosevic.
Regulatory authorities in Canada have rebuffed Prince von Anhalt's
attempts at cooperation and they do not want the evidences to come out.
Jurgen's famous name makes him an attractive target for prosecutors intent on
demonstrating their regulatory power. This prosecutorial zeal, combined with
an insider conspiracy, has lead to a rush to judgment and an undermining of
procedural fairness in Jurgen's case," says Milosevic
Prince von Anhalt is eager to reinvigorate Lydia Diamond Exploration and
see it realize its potential. He has invested substantial time, effort and
personal resources into the company. An independent accounting by the well
respected international accounting firm of KPMG, (ordered by the OSC), found
that the company owes Jurgen hundreds of thousands of dollars.
The interests aligned against Jurgen in the court proceedings in Canada
make it difficult for him to have his side of the story told. Nevertheless,
Jurgen has strong faith in the Canadian justice system and continues to
believe that the courts will see through the conspiracy against him and ensure
that justice is served in his case.
