Press Release No. 3 - By-election of September 24, 2007 - Private Intervenors

    QUEBEC CITY, Aug. 24 /CNW Telbec/ - In view of the by-election scheduled
in the Charlevoix electoral division on September 24, 2007, the Chief
Electoral Officer of Québec, Me Marcel Blanchet, would like to remind the
public about the rules governing the status of private intervenor.
    Pursuant to the Election Act, any election expense incurred during a
by-election to directly or indirectly promote or oppose a candidate or party
during the election period must be incurred and authorized by the official
agent of a candidate. However, the Election Act offers the possibility for
electors or groups not constituted as legal entities and the majority of whose
members are qualified electors, to incur expenses in order to publicize their
opinion on a topic of public interest, by assigning them the status of private
    To enjoy this status, the elector or group representative must first
obtain an authorization from the returning officer of the Charlevoix electoral
division. For the September 24th by-election, the application for
authorization must be submitted between August 28th and September 11th

    Although private intervenors can publicize their opinion on a topic of
public interest or advocate abstention or the spoiling of ballots, they cannot
directly promote a candidate or party. Neither can they be members of a party
or act directly on behalf of a candidate or party.
    In addition, private intervenors can only incur publicity expenses of no
more than $300 from their personal property in order to publicize their
message. However, the Act forbids private intervenors from incurring expenses
jointly with anyone else; that is, another private intervenor, a political
party, a candidate, etc.
    Private intervenors must submit a return of all their expenses to the
Chief Electoral Officer within 30 days after polling day.
