MARKHAM, ON, Aug. 29 /CNW/ - Pet Valu, Inc. and Pet Valu Canada Inc. (the
"Pet Valu Companies") have been advised that that they have been added as
defendants, along with certain other pet food retailers, in a potential class
proceeding brought in the Supreme Court of British Columbia ("BC Action"). The
BC Action involves allegations concerning the manufacture and sale of pet food
products alleged to contain tainted ingredients.
The Pet Valu Companies are in the process of determining whether they
have been properly joined as defendants in the BC Action, given that they do
not carry on business in British Columbia. They intend to vigorously defend
themselves in this matter in any event.
On July 30, 2007, the Pet Valu Companies announced that a motion was
being pursued in the Court of Queen's Bench in the Province of Saskatchewan to
include the Pet Valu Companies among other defendants in a class action
lawsuit in that province involving similar allegations (the "Saskatchewan
Action"). That motion has been allowed but without prejudice to the right of
the Pet Valu Companies to seek a stay of the Saskatchewan Action on
