Pamela Ann Breyer permanently banned from approval

    CALGARY, Nov. 5 /CNW/ - A Hearing Panel of the Investment Dealers
Association of Canada (IDA), appointed pursuant to By-law 20, has imposed a
discipline penalty on Pamela Ann Breyer, at the material time an Approved
Person at Calgary's Water Mark Tower branch of CIBC World Markets Inc. (CIBC),
a Member of the IDA.
    On September 18, 2007, the Hearing Panel considered, reviewed, and
accepted a Settlement Agreement negotiated between staff of the IDA's
Enforcement department and Ms. Breyer. Pursuant to the Settlement Agreement,
Ms. Breyer admitted that during November 2004 to March 2005, she forged the
signatures of three other CIBC registrants on various client account
documentation, thereby engaging in conduct unbecoming or detrimental to the
public interest, contrary to By law 29.1. The investigation in this matter
arose out of a Notice of Termination and a ComSet Event report submitted by
CIBC in late April 2005. The ComSet report indicated allegations of
falsification/forgery of documents.
    In determining penalty, the Hearing Panel considered mitigating factors
that Ms. Breyer did not benefit personally; there was no evidence of any
financial or other harm to CIBC clients; Ms. Breyer was completely cooperative
with the investigation and prosecution of this matter; and most significantly,
medical evidence indicated that Ms. Breyer is unable to function in the
investment industry.
    The Panel also considered aggravating factors that forgery is always
serious; there was more than one act of forgery; the misconduct continued over
a significant period of time; and there was no apparent attempt by Ms. Breyer
to have the individuals sign the documents in question.
    For her misconduct, Ms. Breyer has been assessed a permanent ban of
approval of registration in any capacity with the IDA.
    Ms. Breyer has not been registered with an IDA Member firm since April
28, 2005.
