Member of the Commercial Chamber of Superior Court of Lima was questioned and the Shahuindo Case hearing has not taken place

    LIMA, Peru, April 27 /CNW Telbec/ - The hearing by the Commercial Chamber
of Superior Court of Lima of the Nullity Petition filed by Algamarca, in which
it seeks to have the Arbitration Award issued in Sulliden's favour declared
null and void, has not taken place on Friday April 27 since a member of this
court, Mr. Emilse V. Niquen, was questioned by the plaintiff, Compania Minera
Algamarca S.A.
    Algamarca challenged the participation of Mr. Emilse Niquen because two
years ago this judge was involved in a previous process of the Shahuindo Case.
Since he has a known opinion on the case, this could have result in a biased
    Sulliden Exploration Inc., owner of its subsidiary Sulliden Shahuindo
S.A.C., recently informed in Toronto the rescheduled of the hearing for April
27, 2007 in order to finally resolve all aspects of this dispute.
    The Superior Court of Lima will call a new third member to join the
Commercial Chamber while the questioning against Mr. Niquen is resolved and
the hearing is rescheduled.
    Sulliden Shahuindo S.A.C. has previously challenged members Ruiz Torres,
Lama More and another two judges.
    Minera Algamarca, alleging violations to the process, seeks the Nullity
of the Arbitration Award issued in June 2006 in favour of Minera Sulliden
Shahuindo S.A.C., which declared its ownership to the Shahuindo property. The
Arbitration Tribunal was presided by Mr. Jorge Santistevan de Noriega, former
Ombudsman, involved in a social case where Sulliden Exploration Inc. was one
of the parties facing contamination charges in the mining concession of
"Huaquillas" (San Ignacio, Cajamarca, Peru). Mr. Fernando Cantuarias -the
second member of the tribunal-, labour related to Sulliden Shahuindo S.A.C's
former vice president of legal affairs Mr. Enrique Lastres, and Mr. Victor
Avila -third member- chosen by Sulliden.
    The Constitutional Tribunal ordered, through the Superior Court of Lima,
the Commercial Chamber of Lima to previously resolve the petition of Minera
Algamarca regarding violations to the process probably committed by the
Arbitration Tribunal.
