VANCOUVER, Jan. 28 /CNW/ - The March 31, 2008, decision of a Hearing
Panel of the Investment Dealers Association of Canada (IDA) in the matter of
Mark Pierre Lotz (the Appellant) was reviewed by an IIROC Appeal Panel on
December 4, 2008.
The Appeal Panel released its decision on January 5, 2009. The Appeal
Panel adjusted the amount of the fine and costs; as a result the sanction is:
(a) payment of a $20,000 fine;
(b) payment of $5,000 in costs; and
(c) a requirement that the Appellant successfully complete the
examination based on the Partners, Directors, and Officers Course
administered by the Canadian Securities Institute.
IIROC formally initiated the investigation into the Appellant's conduct
on November 22, 2006. The violations occurred when the Appellant was the Chief
Financial Officer with the 1177 West Hastings Street Branch of Golden Capital
Securities Ltd. The Appellant is currently an officer (non-trading) and
director (non-trading) with the 1055 West Hastings Street Branch of Gateway
Securities Inc. an IIROC-regulated firm.
