Disabled Students Take McGuinty Government to Court

    Faith Based School Students Proceed to Trial Against McGuinty Government

    TORONTO, May 5 /CNW/ - Eight Ontario families with disabled children who
attend faith based (non-Catholic) schools are going to court against the
McGuinty government in a major challenge to the Government's treatment of the
disabled. The constitutional challenge will be heard in Ontario's Divisional
Court in Toronto on May 27 and 28, 2009, announced the families' lawyer, Allan
    Lawyers for the McGuinty government will be asked to explain why
Ontario's Ministry of Health funds services for many types of disabled
children enrolled in faith based schools, but excludes the blind, deaf, and
learning disabled children from that funding. By contrast, the blind, deaf and
learning disabled students who are enrolled in public schools and Catholic
schools in Ontario qualify for full government funding to enable them to learn
in school.
    "Ontario's Health Minister, David Caplan, has become another obstacle
that blind, deaf, and learning disabled students must overcome when they
attend faith based schools", said Allan Kaufman, a lawyer for the families of
the children.
    Minister Caplan allocates the sum of $14.4 million dollars each year to
assist disabled students in all of Ontario's faith based schools. However, the
lawsuit has uncovered new information which shows that Mr. Caplan's Ministry
spends only about $4.5 million of that amount each year. Notwithstanding the
pressing needs of the disabled school children, the sum of almost $10 million
dollars is not being spent on the children. This is because Minister Caplan
prevents the blind, deaf, and learning disabled from getting the help that
they need in faith based schools. "Health Minister David Caplan is in effect
standing in the school house doors to block these children from getting a fair
chance to be educated in their own religion", said Mr. Kaufman.
