Court Bulletin - Winchester company fined $100,000 after worker killed

    MORRISBURG, ON, June 24 /CNW/ - Weagant Farm Supplies Ltd. pleaded guilty
and was fined $100,000 in the Ontario Court of Justice yesterday in connection
with the death of a worker at its dealership on County Road 43 in Winchester.
    Justice of the Peace Louise Rozon heard that on September 13, 2006, an
employee had been assigned to prepare a forage harvester for delivery to a
buyer. The worker had installed the crop processor and engaged the power to
run it. The feed rolls were in motion. They were not shielded by an
attachment. The worker's arm became entangled in the moving mechanism. The
worker's upper body was pulled through the feed rolls and into and through the
cutting blades, resulting in massive fatal injuries.
    A Ministry of Labour investigation concluded that the incident could have
been prevented had the employer taken the necessary steps to ensure all motion
on the harvester that could endanger a worker was stopped and blocked to
prevent movement before and during maintenance, as required by section 75 of
the Regulation for Industrial Establishments. This was contrary to section
25(1)(c) of the Occupational Health and Safety Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
