Court Bulletin - Waterloo company fined $50,000 after worker injured

    KITCHENER, ON, June 19 /CNW/ - A Waterloo high precision machining and
assembly company pleaded guilty and was fined $50,000 in the Ontario Court of
Justice, June 17, 2008, in connection with an injury to a worker.
    Justice of the Peace R. Gay heard that on November 21, 2006, an employee
of Wit Manufacturing Ltd. was operating a chop saw (circular saw) to cut
aluminum bar stock at the company's 136 Dearborn Pl. premises. Two of the
worker's fingers were almost severed by the spinning saw after the worker slid
a piece of bar stock into place on the machine.
    A Ministry of Labour investigation found that the saw was not adequately
guarded and did not prevent access to the saw blade. The company pleaded
guilty to failing, as an employer, to ensure that the rotating saw blade was
equipped with, and guarded by, a guard or other device that prevented access
to the moving part as prescribed by section 24 of Ontario Regulation 851. This
was contrary to section 25(1)(c) of the Occupational Health and Safety Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
