Court Bulletin - Store manager fined $5000 after obstructing inspector

    FORT ALBANY, ON, Feb. 25 /CNW/ - Hector Ugarte, manager of Fort Albany
Northern Store, was fined $5000 on February 19, 2009, for a violation of the
Occupational Health and Safety Act (OHSA), after obstructing a Ministry of
Labour health and safety inspector.
    On February 25, 2008, an inspector with the Ministry of Labour was
conducting a routine inspection of the Fort Albany Northern Store in Fort
Albany. The manager, Mr. Ugarte, refused to cooperate or speak to the
    Hector Ugarte was found guilty under the OHSA of hindering, obstructing,
molesting or interfering with an inspector in performance of his duty under
the OHSA.
    The fine was imposed by Judge Ralph Carr. In addition to the fine, the
court also imposed a 25-per-cent victim fine surcharge on the total, as
required by the Provincial Offences Act. The surcharge is credited to a
special provincial government fund to assist victims of crime.
