Court Bulletin - Solis Mexican Foods Inc. fined $60,000 after worker injured

    STRATFORD, ON, Jan. 20 /CNW/ - Solis Mexican Foods Inc., a
Stratford-based producer of flour and corn products, was fined $60,000 for a
health and safety violation on January 13, 2009, after a worker was injured.
    On September 9, 2007, at the company's facility on James St. South in St.
Marys, a worker was operating a tortilla chip sheeter. The worker noticed
dough accumulating under the machine's rollers, and attempted to clear the
area by hand while the machine was still running. The worker's hand was caught
in the machine and severely injured.
    A Ministry of Labour investigation found that the tortilla chip sheeter
was not equipped with a guard to prevent access to its moving parts. Solis
Mexican Foods Inc. pleaded guilty to failing, as an employer, to ensure that
the measures and procedures prescribed by section 24 of Ontario Regulation 851
for industrial establishments were carried out. This was contrary to section
25(1)(c) of the Occupational Health and Safety Act.
    The fine was imposed by Justice of the Peace Terence Steenson in the
Ontario Court of Justice, Stratford. In addition to the fine, the court
imposed a 25-per-cent victim fine surcharge on the total, as required by the
Provincial Offences Act. The surcharge is credited to a special provincial
government fund to assist victims of crime.
