Court Bulletin - Nestle Canada fined $70,000 after worker injured

    TORONTO, Aug. 14 /CNW/ - Nestle Canada Inc. pleaded guilty and was fined
$70,000 in the Ontario Court of Justice, August 7, 2008, following an injury
to a worker.
    On August 21, 2007, a worker was asked to clean a cream depositor at the
company's 72 Sterling Rd., Toronto, location where Coffee Crisp chocolates
were made. The machine was used in the layering process to make the
chocolates. Rollers on the machine were in motion when the worker attempted to
clean them with a rag. The worker's finger was drawn into the rollers,
resulting in injury that required amputation.
    A Ministry of Labour investigation found the machine was not stopped and
locked-out before being cleaned.
    Nestle Canada Inc. pleaded guilty before Justice of the Peace Jacob
Bruinewood to failing, as an employer, to ensure that the measures and
procedures prescribed by section 75 of Ontario Regulation 851 were carried
out, contrary to section 25(1)(c) of the Occupational Health and Safety Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
