Court Bulletin - Lakeport Brewing GP Inc. fined $50,000 after worker injured

    HAMILTON, ON, Jan. 20 /CNW/ - Lakeport Brewing GP Inc., a Hamilton-based
beer producer, was fined $50,000 for a health and safety violation on January
20, 2009, after a worker was injured.
    On July 20, 2007, a line mechanic at the company's Burlington St.
facility, in Hamilton, was fixing a squeaky roller on a conveyer line. The
worker was crouching under the moving conveyer to spray lubricant on the
roller, when the worker's hand was caught and pulled between the roller and
conveyer belt. The worker suffered a broken arm and crushing injuries to the
    A Ministry of Labour investigation found that the conveyer was not
guarded to prevent access to the pinch point between the moving roller and
conveyer belt. Lakeport Brewing GP Inc. pleaded guilty to failing, as an
employer, to ensure that the equipment, materials and protective devices
prescribed by section 25 of Ontario Regulation 851/90 for industrial
establishments were provided. This is contrary to paragraph 25(1)(a) of the
Occupational Health and Safety Act.
    The fine was imposed by Justice of the Peace Hugh Brown in the Ontario
Court of Justice, Hamilton. In addition to the fine, the court imposed a
25-per-cent victim fine surcharge on the total, as required by the Provincial
Offences Act. The surcharge is credited to a special provincial government
fund to assist victims of crime.
