Back To Work Legislation Leaves Students No Other Option But For the J&R Class Action

TORONTO, Jan. 29 /CNW/ - The law offices of Juroviesky & Ricci LLP
("J&R") commend the Ontario legislature for its passage of the York University
back-to-work legislation.
However, Henry Juroviesky, the managing partner of J&R, is concerned that
on a going forward basis, this legislation serves only to embolden York
University management to be unreasonable in their treatment of its students.
"We are happy that students can continue their lives and do not have to
remain in limbo over the state of their educational affairs. However, we are
concerned that this legislation will allow York University, and other
educational institutions, to rely upon governmental intervention to avoid the
provision of high quality and fair educational services that students pay 'top
dollar' for. It is apparent that during negotiations, York University did not
make the welfare of its students their paramount concern. In our view, rather
than acting as a vehicle to facilitate students' academic growth and
interaction with the society around them, York has acted more like a
corporation, allowing its regard for 'students/consumers' and 'quality of
service' to fall by the wayside."
"As such, in order for the students to be made whole, the only course of
redress now is our lawsuit. The goals of this action are to extend access of
justice to York students, as well as coerce the University to modify its
The suit claims that York University students are entitled to a refund of
their tuition, other fees paid to York, as well as damages (direct and
indirect) for losses suffered by students enrolled in full and part time
programs at York University for the Fall/Winter 2008/2009 semester. For
further details, please see the press release and materials posted on

The detailed statement of claim filed with the Ontario Superior Court of
Justice is the result of an extensive and independent investigation conducted
solely by J&R. To our knowledge, no other action has been filed against the
Defendant in this matter.
