A FIRST IN QUÉBEC'S LABOR LAW - The Superior Court Forces a Labor Union to Present the Offers of an Employer

MONTREAL, May 3 /CNW Telbec/ - Thanks to a decision handed down April 20 by judge Hélène Lebel from the Superior Court of Québec, 150 union employees from the Montréal Château Champlain Hotel will at last be able to vote on their employer's offer.

Last December 4, the employees had to hire an attorney to present the Superior Court with an application for order to force their union organization to present them with their employer's offer, which their union had refused to do for several weeks.

The union meeting will finally be held Thursday, May 4, at the Caf'Conc hall of the Chateau Champlain hotel.

Such a decision, which is a first in Québec, could radically alter the union culture and put an end to the systematic obstruction strategy used by unions, including the CSN.

Main highlights

The tug-of-war started in September 2010, when the hotel management informed the union committee that it was planning to proceed with a major renovation project that involved a multi-million dollar investment. The hotel management then informed the committee that it wished to reopen the collective labor agreement to guarantee industrial peace for an additional four years after the ongoing agreement, which was scheduled to end on June 30, 2012.

October 19, 2010, the employees' general assembly requested the negotiation committee to reopen the labor agreement.

October 27, 2010, after the employer had submitted a final offer, the labor union told employees that they would not submit the management's offer to the employees and that there would be no general assembly on that subject.

November 4, 2010, the union employees presented their labor union with a petition, in conformity with their constitution and bylaws, requesting that their employers offer be presented to them because they wished to have the opportunity to take an objective decision.

When their labor union refused, the employees decided to take the case before the Superior Court to uphold their rights with an application for order, which was granted them on April 20, 2011.

The hotel management is happy that its employees will at last be informed of the final offer submitted on October 26, 2010, and that they will have full opportunity to make a decision. Their decision will be crucial to the future of the hotel and its profitability.
