TORONTO, Dec. 14, 2015 /CNW/ - In 2012, VFA Inc. acquired RECCAP, a small division of the Canadian company, Altus Group, which held the majority of the Canadian market share across the country. A wide range of public and private-sector Canadian clients in the fields of health care, higher education and municipal governance rely on the VFA Facility for accurate financial forecasting purposes to properly manage and maintain their assets and facilities. In late 2014, VFA was acquired by Accruent Canada Inc., a US based Software Company.
The Plaintiff alleges the workplace harassment began in March 2015 after receiving questions and complaints from Canadian clients about the funding module which he immediately brought to the attention of VFA management. The Plaintiff alleges senior management and its developers refused to address the concern that the funding module had a software bug and disregarded the findings and suggestions demonstrating just that. The Plaintiff subsequently informed the parent company of VFA namely, Accruent, in light of the liability issues that could accrue if this issue was not addressed in a timely manner.
In August, 2015 the Plaintiff was invited to VFA headquarters in Boston, Massachusetts to further discuss his findings regarding the funding module however, and rather than be applauded for raising a critical concern with public interest implications, he was given a Performance Improvement Plan (PIP), colloquially equated to a 'pink slip' followed by systematic and patterned alienation in contravention of provincial health and safety legislation.
The Performance Improvement Plan further stated: "You have been unable to commit to explaining to the customer how the software works as it is designed today. Because of your messaging, clients and users question the accuracy of some funding calculations; inconsistent messaging being delivered to the customers creates detractors of the Software and of Accruent."
