RENT INCREASES IN 2009



    MONTREAL, Jan. 26 /CNW Telbec/ - The Régie du logement is releasing today
estimated average rent increases determined in accordance with the Regulation
respecting the criteria for the fixing of rent. The estimates provide
landlords and tenants with a basis for discussion in order to encourage
agreement on a rent increase that is satisfactory for both parties.
    The Régie points out that these average increases do not take into
account the specifics of a particular building. In some cases, the operating
expenses related to a building could justify a rent increase that does not
reflect the averages indicated.
    The table below provides an estimate of the basic increase, without
taking into account changes in municipal and school taxes and major
improvements to the building.

    So that you can obtain a calculation specific to your dwelling, the Régie
du logement is making available to landlords and tenants the form Calculation
2009 / How to agree on the rent. The form allows tenants and landlords to
calculate the rent more precisely, taking into account any changes in
municipal and school taxes, major improvements, as well as the overall
operating expenses applying to the building.
    The interactive version of the form is currently available on the Website
of the Régie du logement at http://www.rdl.gouv.qc.ca. The paper version of
that form will also be available during the second week of February.
    It is important to note that specific rules apply to residential rent
increases. You will find these rules, as well as models that can be used for
notices of rent increase and replies to notices of rent increase, on the Régie
du logement Website. Note that when the tribunal sets rent, the judicial
calculation is based on the building's operating expenses and not the average
estimates.
