QUEBEC CITY, Jan. 31 /CNW Telbec/ - The Chief Electoral Officer of
Québec, Me Marcel Blanchet, would like to inform the public that two
convictions have been obtained regarding violations of the Act Respecting
Elections and Referendums in Municipalities.
The same offence occurred in February 2006 in two municipalities in the
Following the municipal elections of November 6, 2005, Mr Mark James
Ryan, an independent candidate in La Pêche, and Mrs Linda Davis, an
independent candidate in Val-des-Monts, failed to file with the treasurer of
their municipality their financial statement and their return of election
Since both independent candidates were their own official agent and
representative, Mr Ryan and Mrs Davis had to file their report and return
latest February 4, 2006.
Sections 484 and 492 of the Act Respecting Elections and Referendums in
Municipalities stipulate that the official agent and official representative
of an authorized independent candidate must, within 90 days after polling day,
file a financial report and a return of election expenses with the treasurer
of the municipality. By failing to file the report and return, Mr Ryan and Mrs
Davis were in violation of the Act Respecting Elections and Referendums in
During their respective hearings on January 12, 2007, Mr Ryan and
Mrs Davis were found guilty of the charges brought against them and were
ordered them to pay a $250 fine, plus costs.
