Permanent Injunction - St-Hubert Group Inc. obtains a permanent injunction from the Federal Court



    LAVAL, QC, April 23 /CNW Telbec/ - The Federal Court of Canada issued a
default judgment against 0753882 B.C. Limited on March 12, 2007, pursuant to a
complaint filed by St-Hubert Group Inc. for copyright and trade-mark
infringement.
    The Court granted a permanent injunction against 0753882 B.C. Limited,
its administrators and officers as well as any other persons under their
control, enjoining them to:

    
    1. cease any and all use of the rooster head logo currently used by the
       restaurant Montreal BBQ located on Hastings Street in the City of
       Vancouver or any other logos or trade-mark confusingly similar with
       the copyrighted trade-marks of St-Hubert Group Inc.;
    2. cease any and all use of the trade-mark FAMILIAL 4 and REGAL JUNIOR in
       association with any products or services relating to restaurant or
       food services;
    3. cease all false or misleading representations tending to discredit the
       business, products and services of St-Hubert Group Inc.;
    4. cease all false representations leading to believe that 0753882 B.C.
       Limited or any of its representatives are associated with St-Hubert
       Group Inc.
    

    The Federal Court also ordered that a reference be conducted with respect
to the issues of damages and accounting of profits by the Defendant in favour
of the Plaintiff.
