MONTRÉAL, May 11 2016 /CNW Telbec/ - Further to a complaint filed by Ms. Kelly Martin against Desma inc., a company operating in doors and windows, the Commission des droits de la personne et des droits de la jeunesse (hereafter the Commission) instituted legal proceedings and alleged that Ms. Kelly Martin was forced to leave her employment after informing her employer Desma inc. that she was pregnant, the whole as it appears from the Tribunal des droits de la personne's file bearing the number 500-53-000421-154.
The parties have however agreed to an out-of-court settlement before the trial was set to begin.
The parties recognize the importance of ensuring equal employment opportunities for women. They also recognize and reaffirm the importance of providing a discrimination and harassment-free workplace where all individuals are treated with respect and dignity, can contribute fully and benefit from equal opportunities.
Desma inc. has always and will continue to promote a safe and healthy work environment, exempt of any form of discrimination.
The Commission reiterates that, pursuant to the Charter of Human Rights and Freedoms, every person has a right to full and equal recognition and exercise of his or her rights without distinction, based, in particular, on pregnancy or having children."
The Commission des droits de la personne et des droits de la jeunesse (Human Rights and Youth Rights Commission) ensures the promotion and respect of the principles set out in the Québec Charter of Human Rights and Freedoms. It also ensures that the interests of children are protected and that their rights recognized in the Youth Protection Act are respected and promoted. In addition, the Commission oversees compliance with the Act Respecting Equal Access to Employment in Public Bodies.
