Ottawa company fined in Cobourg worker injury



    COBOURG, ON, March 5 /CNW/ - An Ottawa maker of roof trusses was fined
$55,000 in the Ontario Court of Justice after a worker at its Cobourg plant
was injured on the job.
    Justice of the Peace Allison Forestall heard that Stork Holdings Inc. and
Balsam Fir Investments Inc., operating as Kott Lumber of 3228 Moodie Dr.,
Ottawa, had a workplace at 581 Thompson St., Cobourg. At that plant, on April
25, 2006, a worker was manually feeding a small roof truss into a finish press
machine. The worker was caught by the moving truss and dragged toward the
rollers of the machine. The truss broke and the worker escaped with minor
injury.
    The defendant pleaded guilty to failing, as an employer, to ensure that
the truss gantry system and/or finish press that had an exposed moving part
that endangered the safety of the worker was equipped with, and guarded by, a
guard or other device that prevented access to a moving part. This safety
equipment is required by section 24 of Ontario Regulation 851. The company's
failure was contrary to section 25(1)(a) of the Occupational Health and Safety
Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge, as required by the Provincial Offences Act. The surcharge is
credited to a special provincial government fund to assist victims of crime.
