TORONTO, May 5 /CNW/ - Today the Ontario Energy Board has issued an Order
pursuant to section 112.5 of the Ontario Energy Board Act, 1998 (the
"Act")that Direct Energy Marketing Limited ("DE") pay an administrative
penalty in the amount of $15,000.00.
The penalty is related to one instance of making false and misleading
statements to a consumer, breaching both section 88.4(2) of the Ontario Energy
Board Act (unfair practice) as well as section 2.1 of the Code of Conduct for
Gas Marketers (false and misleading statements).
Direct Energy has paid the fine in full. The funds received by the Board
will be used to support activities that are in the public interest.

A Notice of Intention to make an Order for an Administrative Penalty was
issued against Direct Energy on April 23, 2009. The company was notified that
the Ontario Energy Board, on its own motion, intended to make an Order under
subsection 112.5 of the Act requiring Direct Energy to pay an administrative
penalty for contravening certain enforceable provisions of the Act.
The Ontario Energy Board regulates the province's electricity and natural
