Notice to public: Settlement hearing in the matter of Standard Securities Capital Corporation and Mark Andrew Marcello



    TORONTO, Jan. 18 /CNW/ - The Investment Dealers Association of Canada
(IDA) announced today that a hearing will be held before a Hearing Panel
appointed pursuant to By-law 20 for the presentation, review and consideration
of a Settlement Agreement.
    The Settlement Agreement is between IDA staff and Standard Securities
Capital Corporation (Standard) and Mark Andrew Marcello. Standard was at all
material times a Member of the IDA with its office in Toronto, Ontario, and
Mr. Marcello was at all material times the UDP of the firm. Mr. Marcello is
currently employed with Standard. The Settlement Agreement relates to matters
for which Standard and Mr. Marcello may be disciplined. The conduct which is
the subject of the hearing occurred during the time period from May 2002 -
February 2007.
    The charges against Standard include failure to maintain, oversee and
implement an effective sales compliance program contrary to Regulation 1300,
Policy 2 and By-law 29.3A.
    The charges against Standard and Mr. Marcello include failure to:
adequately supervise a client account; adequately supervise an RR in respect
to outside business activities; adequately supervise and to learn and remain
informed of essential facts relative to certain client accounts, contrary to
Regulation 1300, Policy 2 and By-law 29.1.
    The charges against Mr. Marcello include failure to use due diligence to
learn the essential facts relative to a client and orders accepted on behalf
of his client and to ensure that such orders were within the bounds of good
business practice contrary to Regulation 1300.
    The hearing is scheduled to commence at 10:00 a.m. on Wednesday, January
30, 2008, at Legal Transcript Services, 111 Richmond Street West, Suite 1500,
Toronto, Ontario. The hearing is not open to the public unless and until the
Settlement Agreement has been accepted by the Hearing Panel. Copies of the
decision of the Hearing Panel and the Settlement Agreement will be made
available if and when the Settlement Agreement is accepted by the Hearing
Panel.
