Mississauga candle maker fined $60,000 after worker injured



    BRAMPTON, ON, Sept. 12 /CNW/ - A Mississauga candle making company
pleaded guilty and was fined $60,000 in the Ontario Court of Justice,
September 9, 2008, in connection with an injury to a worker.
    Justice of the Peace M. Mcleod heard that on April 14, 2007, the worker's
wrist was fractured and forearm cut during the operation of a candle shaving
machine at Premier Candle Corp, 960 Britannia Rd. The worker's arm had become
pinched in a gap exposed at the back of the machine.
    A Ministry of Labour investigation found that there were no guards in
place to prevent a worker from accessing the moving parts and pinch points of
the machine. This was contrary to section 25 of Ontario Regulation 851.
Premier Candle Corp. pleaded guilty to failing, as an employer, to ensure that
the measures and procedures prescribed under the regulation were carried out,
contrary to section 25(1)(c) of the Occupational Health and Safety Act.
    In addition, the court imposed a 25-per-cent victim fine surcharge, as
required by the Provincial Offences Act. The surcharge is credited to a
special provincial government fund to assist victims of crime.
