Legal proceedings instituted by the Chief Electoral Officer under the Act respecting elections and referendums in municipalities - A conviction handed down and a guilty plea entered



    QUEBEC, June 13 /CNW Telbec/ - Marcel Blanchet, Chief Electoral Officer
of Québec, wishes to inform the public that a conviction was handed down and a
guilty plea entered in cases concerning violations of the Act respecting
elections and referendums in municipalities (AERM).

    Bas-Saint-Laurent region

    The first violation occurred following the November 6, 2005 municipal
election in the City of Rimouski. Ms. Suzie Fortin, who had run as an
independent candidate and who was acting as her own official representative,
failed to file with the city treasurer not later than April 1, 2007 an
additional financial report confirming the payment of all of the debts arising
from her election expenses. Ms. Fortin thereby contravened section 485 of the
AERM and committed the violation stipulated in section 626 of said Act.
    Following the hearing by default held on May 20, 2008, she was found
guilty of the charge brought against her. The judge ordered her to pay a $250
fine, plus expenses.

    Laurentides region

    The second violation was committed in Saint-Eustache on or about June 23
and on or about August 24, 2005. Mr. Nicolas Samson incurred a party expense
on two occasions for an advertisement, without being the official
representative of the Equipe Lauzon Team/Action Deux-Montagnes party, thereby
contravening section 443 of the AERM. This section stipulates that expenses
other than election expenses of an authorized party or independent candidate
may be incurred only by the official representative or by a person designated
by him in writing for that purpose. By incurring a party expense, Mr. Samson
committed the violation stipulated in section 611 of the AERM.
    On May 8, 2008, Mr. Samson sent the Chief Electoral Officer of Québec a
guilty plea in response to the charge brought against him. He paid the $500
fine, plus expenses.
