TORONTO, Aug. 8 /CNW/ - Juroviesky and Ricci LLP and Ken Alexander of
Ball and Alexander announced today, that Mr. Justice Perell of the Ontario
Superior Court gave his approval to the proposed settlement of the Overtime
Class Action against KPMG.
The approved settlement uses the KPMG Overtime Redress Plan process as
the basis for the settlement for the class action claims. All Class Member
Employees would be able to utilize the processes of the ORP as a method for
dealing with the claims in the Class Action.
"We are pleased that we were able to achieve consent on this unique
process for the adjudication of the Class Claims", said Juroviesky, one of the
lawyers who brought the suit.
"It is always in everyone's best interest for claims to be resolved
without the time and expense of unnecessary litigation. However, in this case,
the ORP is a process settlement, and not a compromise of claims settlement, so
it is doubly efficient", he said.
"This ushers in the new wave of compliance with Provincial Overtime Law",
said Ken Alexander, an employment lawyer, and co-counsel on the Class Action.
The hearing for the final approval of the settlement and Certification of
the action for settlement purposes was held on August 7th, 2008. Formal
