IN THE MATTER OF Yuan Jun Fan - Settlement



    VANCOUVER, Oct. 10 /CNW/ - Notice is hereby given that a hearing will be
held before a Hearing Panel of the Investment Dealers Association of Canada
(IDA) on Wednesday, October 22, 2008 at Reportex Agencies Ltd., located at
Suite 1010, 925 West Georgia Street, Vancouver BC, at 10 00 am or as soon
thereafter as the hearing can be held, to consider whether, pursuant to By-law
20.36 of the IDA Rules, the Hearing Panel should accept a Settlement Agreement
entered into between Staff of IIROC and Yuan Jun Fan (the Respondent).
    The subject matter of the proposed Settlement Agreement concerns
allegations that:

    
    (1)    The Respondent failed to act in accordance with industry standards
           of conduct requiring trustworthiness, honesty and fairness in all
           business dealings with clients; in that by false representation
           and breach of client trust, he involved a client (G.L.) in a
           fabricated securities transaction and thereby exposed the client
           to financial loss, which conduct is unbecoming a registrant and
           detrimental to the public interest, contrary to By-law 29.1 of the
           Investment Dealers Association of Canada.

    (2)    The Respondent failed to act in accordance with industry standards
           of conduct requiring avoidance of personal financial dealings with
           clients and RBC internal policy relating to private placements; in
           that he involved a client (G.L.) in an off-book securities
           transaction:

           -  involving a sharing of profits between the Respondent and G.L,
              and
           -  the Respondent's guarantee of G.L.'s capital investment,

              without the knowledge and approval of RBC, which is conduct
           unbecoming a registrant and detrimental to the public interest,
           contrary to By-law 29.1 of the Investment Dealers Association
           of Canada.
    

    The IDA formally initiated the investigation into the Respondent's
conduct on June 13, 2007. The violations occurred when the Respondent was a
Registered Representative with the Vancouver Park Place Branch of RBC Dominion
Securities Inc. (RBC). The Respondent is not a registrant with an Investment
Industry Regulatory Organization of Canada (IIROC) regulated firm.
    The hearing is not open to the public unless and until the Settlement
Agreement has been accepted by the Hearing Panel. If the Hearing Panel accepts
the Settlement Agreement, the Hearing Panel's decision and reasons will be
made available to the public.

    IIROC is the national self-regulatory organization which oversees all
investment dealers and trading activity on debt and equity marketplaces in
Canada. Created in 2008 through the consolidation of the Investment Dealers
Association of Canada and Market Regulation Services Inc., IIROC sets high
quality regulatory and investment industry standards, protects investors and
strengthens market integrity while maintaining efficient and competitive
capital markets. IIROC carries out its regulatory responsibilities through
setting and enforcing rules regarding the proficiency, business and financial
conduct of dealer firms and their registered employees and through setting and
enforcing market integrity rules regarding trading activity on Canadian equity
marketplaces.
