IN THE MATTER OF Dustin Rene Lamontagne - Discipline



    CALGARY, May 12 /CNW/ - Following a disciplinary hearing held on Thursday
December 11, 2008, in Calgary, Alberta, a Hearing Panel of the Investment
Industry Regulatory Organization of Canada ("IIROC") for the Investment
Dealers Association of Canada ("IDA")" found that Dustin Rene Lamontagne (the
"Respondent"):

    
    (a)  While a Registered Representative with the Member, CIBC Investor
         Services Inc. (CIBC), and particularly during the approximate period
         August 2006, engaged in the conduct of forgery of thirteen (13)
         client signatures to the Respondent's client investment plans and
         financial advice disclosure documents, which conduct is unbecoming
         a registrant and detrimental to the public interest, contrary to
         By-law 29.1 of the Investment Dealers Association of Canada; and

    (b)  While a Registered Representative with the Member, CIBC Investor
         Services Inc. (CIBC), and particularly, on or about October 23,
         2006, misled CIBC by providing false information to CIBC in respect
         of client signature irregularities, all involving the Respondent's
         client investment plans and financial advice disclosure documents,
         contrary to By-law 29.1, of the Investment Dealers Association of
         Canada.

    The Hearing Panel imposed the following penalty against the Respondent:

    (a)  Suspension for six months from the date of the Hearing (which makes
         the end of the suspension until June 10, 2009);

    (b)  Fine of $35,000 to be paid within twelve months of the date of the
         Decision;
    

    and required the Respondent to pay costs in the amount of $15,000, also
within twelve months of the date of the Decision.
    The IDA formally initiated the investigation into the Respondent's
conduct on June 4, 2008. The violations occurred when the Respondent was a
Registered Representative with the Edmonton Branch of CIBC Investor Services
Inc. The Respondent is no longer a Registrant with the Investment Industry
Regulatory Organization of Canada (IIROC).
    The Hearing Panel issued its Decision and Reasons on January 27. The
