Court Bulletin - Stelltacc Properties Inc. fined $60,000 and A.R.A. Carpentry fined $40,000 after worker injured



    NEWMARKET, ON, Feb. 27 /CNW/ - Stelltacc Properties Inc., a residential
home builder, and 2049757 Ontario Inc., operating as A.R.A. Carpentry, a
residential framing contractor, both from Vaughan, were fined $60,000 and
$40,000 respectively on February 23, 2009, for violations under the
Occupational Health and Safety Act (OHSA), after a worker was injured.
    On October 6, 2006, Stelltacc Properties Inc. was constructing homes in
Vaughan and A.R.A. Carpentry was a framing contractor at the project. A
carpenter subcontracted by A.R.A. Carpentry was installing rafters while
standing on the second floor top plate, which is a piece of lumber placed
horizontally on top of a wall frame. The top of the wall frame gave way and
the worker fell over six metres (22 feet) to the ground. The worker sustained
foot and leg injuries.
    A Ministry of Labour investigation found that the defendants failed to
ensure that a worker worked from a proper work platform.
    Stelltacc Properties Inc. pleaded guilty under the OHSA to failing, as a
constructor, to ensure that the worker worked from a work platform that
complied with the provisions of the Ontario construction regulation. A.R.A.
Carpentry pleaded guilty under the OHSA to failing, as an employer, to ensure
the same.
    The fines were imposed by Justice Peter Bourque. In addition to the fine,
the court also imposed a 25-per-cent victim fine surcharge on the total, as
required by the Provincial Offences Act. The surcharge is credited to a
special provincial government fund to assist victims of crime.
