Court Bulletin - Rich Products of Canada Limited fined $55,000 for injury of worker



    ST. CATHARINES, ON, Oct. 30 /CNW/ - Rich Products of Canada Limited
pleaded guilty and was fined $55,000 in the Ontario Court of Justice in St.
Catharines on October 29, 2008, after the injury of a worker at their dough
factory in Fort Erie, Ontario.
    Justice of the Peace Mary Shelley heard that on September 25, 2006, at
8-12 Hagey Avenue in Fort Erie an employee was cleaning grease from a running
transfer conveyor belt when the worker's arm was pulled between two unguarded
rollers. The arm was fractured as a result.
    The Ministry of Labour investigation found that contrary to section 25 of
Ontario Regulation 851, the pinch point created by the two rollers was not
guarded. There was a guard in place at the location of the pinch point at some
time prior to the incident but it had been removed. This was contrary to
section 25(1)(c) of the Occupational Health and Safety Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
