Court Bulletin - Owner of Blade Works fined $3,500 for ignoring order to pay



    BURLINGTON, ON, Jan. 23 /CNW/ - Glenn H. Chester, operating as Blade
Works, a business in Limehouse, Ontario, was fined $3,500 on January 19, 2009
for violating the Employment Standards Act (ESA) by failing to comply with an
order to pay wages owed to a former employee.
    The Ministry of Labour investigated a claim for wages owing to a former
employee and concluded wages had not been paid in accordance with the ESA. An
order to pay for $1,981.41 was issued on October 5, 2006 to Mr. Chester
operating as Blade Works. This order to pay was not paid.
    The defendant pleaded guilty to failing to comply with an order issued by
an employment standards officer contrary to section 103(8) of the ESA. This
was an offence under section 132 of the act.
    The fine was imposed by Justice of the Peace L.M. Mills in the Ontario
Court of Justice, Burlington. In addition to the fine, the court imposed a
25-per-cent victim fine surcharge on the total, as required by the Provincial
Offences Act. The surcharge is credited to a special provincial government
fund to assist victims of crime.
