Court Bulletin - Custom truck maker/repairer fined $54,000 after worker injured



    BURLINGTON, ON, Sept. 24 /CNW/ - A Burlington custom truck maker and
repairer pleaded guilty and was fined $54,000 in the Ontario Court of Justice,
September 22, 2008, after a 227 kg bumper fell on a worker's leg.
    Justice of the Peace Jerry Woloshuk heard that an employee of Presvac
Systems (Burlington) Limited had tack welded a bumper assembly to a new
vehicle on July 26, 2006. The next day, the worker was trying to adjust the
bumper's position when the welds failed and the assembly fell on the worker's
leg, breaking it.
    A Ministry of Labour investigation found that the bumper had been
temporarily elevated at the time of the incident, but was not securely and
solidly blocked to prevent it from falling, as required by Section 74 of
Ontario Regulation 851. This was contrary to section 25(1)(c) of the
Occupational Health and Safety Act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
