Court Bulletin - Company directors fined for ignoring order to pay wages



    BURLINGTON, ON, Feb. 29 /CNW/ - Two directors of Aadvanced Merchandising
Inc., of Oakville, were convicted and fined $3,000 each in the Ontario Court
of Justice for failing to comply with a Ministry of Labour order to pay wages
owed to a worker.
    The conviction came after the Ministry of Labour investigated a claim by
an employee of Aadvanced Merchandising Inc. for 121 hours worth of wages
unpaid in September 2004. The ministry issued an order to pay $1,661.82,
including a $151 administration fee. The two directors failed to comply with
the order.
    Emile Bakker and Gerald W. Kinasz, both of Oakville, were found guilty of
committing the offence, as an officer, director or agent of Aadvanced
Merchandising Inc., of authorizing, permitting or acquiescing in a
contravention of section 103(8) of the Employment Standards Act by Aadvanced
Merchanising Inc., contrary to section 137(1) of the act.
    In addition to the fine, the court imposed a 25-per-cent victim fine
surcharge on the total, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime.
