KITCHENER, ON, Sept. 8, 2011 /CNW/ - Kitchener lawyer Mark Silverthorn
denies threatening The Law Society of Upper Canada with negative
publicity if it did not aggressively prosecute a professional
misconduct matter involving Markham lawyer Deanna Natale.
Deanna Natale, daughter of former federal Liberal cabinet minister Judy
Sgro, is currently facing a disciplinary hearing before The Law Society
in connection with her law firm's high-volume debt collection practice
and her firm's use of an imitation of a court form in collection
letters—a practice known as draft statements of claim.
A Hearing Panel at The Law Society is scheduled to deal with the Deanna
Natale professional misconduct matter at 9:30 a.m. on Monday, September
Lawyers representing Deanna Natale filed an Amended Notice of Motion
with The Law Society on August 19, 2011, alleging that "Mr. Silverthorn
wrote to Ms. Worley repeatedly between October 2010 and March 2011,
encouraging her to widen the investigation into Ms. Natale and tacitly
threatening negative media publicity for the Law Society if Ms. Natale
was not aggressively prosecuted."
Ms. Natale's Amended Notice of Motion also alleges abuse of
prosecutorial discretion on the part of lawyers at The Law Society
prosecuting Ms. Natale in connection with her professional misconduct
matter. (http://www.collection-calls.ca/pdf/natale-amended-notice-of-motion.pdf )
Silverthorn says, "I categorically deny (1) repeatedly writing to Amanda
Worley, the Law Society's prosecutor, encouraging her to widen her
investigation into Ms. Natale, and (2) threatening The Law Society with
negative publicity if Ms. Natale were not vigorously prosecuted."
