TORONTO, Nov. 18 /CNW/ - As a result of an application by the Ontario
Securities Commission (OSC), the Superior Court of Justice (Commercial Court)
issued an endorsement on November 14, 2008 approving an order appointing KPMG
as receiver and manager of all the property and assets of ASL Direct Inc.
(ASL).
This matter was heard on November 4, 2008 by Mr. Justice Morawetz of the
Superior Court of Justice (Commercial Court). Mr. Justice Morawetz, having
heard both sides in the contested hearing, provided an endorsement on November
14, 2008 granting the OSC application for the appointment of KPMG as receiver.
Under section 129 of the Securities Act, the Commission may apply to the
Court for an order appointing a receiver and manager where it is in the best
interests of, among others, security holders or subscribers of the company
over which the receiver and manager is appointed, or where it is appropriate
for the due administration of Ontario securities law.
